Please note: If you plan to increase the licensed area by 50% or more, or make significant changes to your current licence, you must apply for a new premises licence rather than using this process.

Why do I need to apply for a variation of my premises licence? 

If you wish to change any of the following activities, you will need to apply to vary your premises licence:

  • The times of the sale of alcohol by retail anywhere, whether for consumption on or off the premises no matter what the quantities are.

  • The provision of, addition of or change of times of regulated entertainment, namely,

    • the performance of a play

    • the showing of a film 

    • an indoor sporting event

    • boxing or wrestling entertainment outdoors

    • the performance of live music

    • the playing of recorded music (excluding incidental background music)

    • the performance of dance

    • entertainment of a similar description to live music, recorded music or dance (where the entertainment takes place in the presence of the public or a section of the public).

  • Providing, or changing the times of providing, hot food or hot drink at any time between 11pm and 5am, for consumption on or off the premises.

When varying a premises licence you also have the opportunity to refresh licence conditions. This can include adding, modifying or removing redundant conditions.

Who can apply for a variation of a premises licence?

Only the person or company who currently holds the premises licence can vary the premises licence.

How to apply

Register your details on the HDC Licensing Portal

Once registered, you will be able to submit your application, upload an amended plan (if applicable) and pay the application fee.

The portal will also allow you to view any updates to your application.

After submission of a valid application

After you submit your application, you must do the following and provide proof to us - otherwise your application may be rejected.

You must display the Notice to Vary a Premises Licence [DOCX, 18KB] at the premises for 28 consecutive days from the day after submission.

The notice must be printed on pale blue paper and retain the font size as per the template. It must be visible to the public without the need for the public to enter your premises, ideally in the window or front door.

You must also advertise the notice in a local newspaper within 10 working days starting from the day after the application is submitted.

The application fee will be determined on the rateable value of the premises.

On the day after an application is received, a 28-day consultation period begins, allowing comments or 'representations' to be made about the application by the responsible authorities and any local residents or 'interested parties'. During this time, the responsible authorities will work with you to ensure your proposals are in line with the four licensing objectives.

If no comments are received during this period, the application will be deemed granted after the last date for representations, and your licence will be issued and sent to you in due course.

If relevant representations are received within the 28-day consultation period, we will attempt to mediate between the parties to try and find a suitable solution. If the mediation is unsuccessful, then a public hearing must be held to determine your application. You will be notified advising you when the hearing will be, who has made a representation and what the concerns are.

The public hearing will be held within 20 working days after the last date for representation. The hearing date may be extended if we consider it is in the public interest to do so.

When you make an application, the details of the application will be published on our website, and the information on any licence granted will be included in a public register.
